Plain-English summary

  • You're buying a license to use DIY Halftones. You don't own the software, but everything you make with it is yours, including for commercial printing.
  • One purchase covers up to 6 people in your business, each on their own computer (6 computers total), and includes both the Windows and Mac versions. Don't share, resell, or post the installer or download link.
  • This is a digital product. All sales are final once the download link is delivered. No refunds. If something doesn't work, contact support first and we'll help.
  • The software is provided "as is." Our liability is limited to what you paid. Florida law applies.

1. Who we are and what this agreement is

These terms are a legal agreement between you and Dimelo 2 Live LLC, doing business as DIY Printz, 5051 S. State Rd 7, Ste 505, Davie, FL 33314 ("DIY Printz," "we," "us"). By checking the acceptance box, downloading, installing, or using DIY Halftones, you agree to these terms. If you don't agree, don't download or use the software.

2. Definitions

3. The Software

Software description and features

DIY Halftones is a standalone DTF (direct-to-film) art-prep desktop application. It is not a plugin and does not need any host application. Version 3.0.1 includes:

The Software works fully offline. It does not require an account, online activation, or a license key.

System requirements

It is your responsibility to check that your computer meets these requirements before you buy. Not meeting them is not grounds for a refund.

4. Who can be a Licensee

You must be at least 18 years old and able to enter a binding contract. You may use the Software for personal or business purposes. If you accept on behalf of a business, you confirm that you are authorized to bind that business, and "you" includes that business.

5. License grant

Subject to these terms and to payment for your Order, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on up to 6 computers that you own or control, for use by up to 6 people within your business, each on their own computer. One purchase covers both the Windows and Mac versions. The 6-computer limit is contractual: the Software does not enforce it, but this agreement does. The license is perpetual for the version you bought, unless it ends under Section 16.

6. Permitted use

8. Updates and versions

We may release updates, fixes, or new versions. Updates we choose to give to existing customers are covered by these terms (or the terms in effect when the update is released). We are not required to provide updates, new features, or support for older operating systems. Major new versions may be sold separately.

9. Digital delivery and NO REFUNDS

Nothing in this section limits rights that applicable law gives you and that cannot be waived.

10. Intellectual property

The Software, including its code, design, name, and documentation, belongs to Dimelo 2 Live LLC (DIY Printz) and/or its licensors and is protected by copyright and other laws. You are buying a license to use it, not ownership. All rights not expressly granted to you are reserved.

11. Your Content

Your artwork stays yours. We claim no ownership of Your Content or of the output files the Software creates from it. The Software runs offline and does not send Your Content to us. You are responsible for having the rights to any artwork you process, including trademarks, logos, and character art.

12. Third-party components

The Software may include third-party or open-source components that are subject to their own license terms. Where those terms apply, they govern that component. The Software includes open-source components, including Electron (MIT), Chromium (BSD-3-Clause and others), Node.js (MIT), FFmpeg (LGPL-2.1), and the Inter, Montserrat and Bebas Neue fonts (SIL Open Font License 1.1). Those components are licensed under their own terms, which are included with the Software and control over this agreement for those components.

13. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Software will be error-free or uninterrupted, or that output will suit a particular printer, RIP, film, ink, or garment. Always test-print before production runs. We are not responsible for wasted film, ink, garments, or reprints.

14. Limitation of liability

To the maximum extent the law allows, our total liability for any claim related to the Software or these terms is limited to the amount you actually paid for the Software. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost business, or production losses.

15. Indemnification

You agree to defend, indemnify, and hold harmless Dimelo 2 Live LLC (DIY Printz) and its owners, employees, and contractors from claims, losses, and costs (including reasonable attorney fees) arising from your misuse of the Software, your breach of these terms, or Your Content (including claims that your artwork infringes someone else's rights).

16. Termination

Your license ends automatically if you breach these terms, for example by sharing or reselling the Software or Download Link. When it ends, you must stop using the Software and delete all copies. We may also disable or expire Download Links. Sections 9 through 15 and 17 through 21 survive termination. Termination for breach does not entitle you to a refund.

17. Privacy and the Signed Record

When you accept these terms, we collect and keep: your full name, email address, order number, IP address, browser user agent, and the date and time of acceptance, plus the terms version and a fingerprint (hash) of the exact text you accepted. We use this only to record your acceptance, deliver the Software, provide support, and defend against disputes or chargebacks. We keep these records on DIY Printz's secure server, and add a summary to your order record in our Shopify store. We do not sell it. We may share it with payment processors or banks in a dispute, or where the law requires. The Software itself does not collect personal data.

18. Electronic signature consent

You agree to sign these terms electronically. Checking the acceptance box and clicking accept is your legal signature, with the same effect as a handwritten signature, under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and Florida's Uniform Electronic Transaction Act (Fla. Stat. § 668.50). You agree to receive these terms and related records electronically. You may request a copy of your Signed Record at any time at sales@diyprintz.com.

19. Governing law and venue

These terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Broward County, Florida, and you consent to that venue.
